Dolphin Publications B.V. is the data controller within the meaning of the General Data Protection Regulation (GDPR) for the personal data processed in the context of agreements with customers and partners.

This statement is specifically aimed at customers, partners and other business relations of Dolphin Publications B.V. For the processing of personal data of visitors to our websites, please refer to the privacy statements on the respective websites.

2. What personal data we process

In the context of our business services, we process the following categories of personal data of contact persons at customers and partners:

  • Name and job title
  • Business email address
  • Business telephone number
  • Name and address details of the organisation
  • VAT number and Chamber of Commerce number of the organisation
  • Invoice and payment details
  • Communications in the context of the assignment, including emails and quotations
  • Attendance details for physical events such as roundtables

We only process personal data that is necessary for the performance of the agreement or that we have received in the context of our business relationship.

3. Why we process your data

Dolphin Publications B.V. processes personal data on the basis of the following legal grounds:

3.1 Performance of the agreement

We process personal data for the performance of agreements with customers and partners. This includes drawing up and sending quotations and invoices, performing agreed services such as content productions, campaigns and events, and the communications necessary for this purpose.

3.2 Legal obligation

Under Dutch tax legislation, we are required to retain invoices and financial records for seven years. In this context, we also process the personal data contained therein.

3.3 Legitimate interest

After the expiry of an agreement, we retain contact details of customers and partners in our CRM system on the basis of our legitimate interest as a business in maintaining business relationships. This includes informing contact persons about relevant events such as roundtables and conducting targeted commercial communications such as invitations for new services. We always weigh this interest against the interest of the data subject and always offer the option to object.

4. How long we retain your data

Dolphin Publications B.V. applies the following retention periods:

  • Financial data and invoice details: 7 years after the end of the financial year, in accordance with the statutory fiscal retention obligation.
  • Contact details in our CRM system: for as long as an active business relationship exists or for as long as there is a legitimate interest in maintaining that relationship. Data subjects may object to further retention at any time.
  • Communications in the context of an assignment: a maximum of 2 years after completion of the assignment, unless longer retention is necessary in the context of a dispute or legal obligation.

5. With whom we share your data

Dolphin Publications B.V. only shares personal data with third parties to the extent necessary for the performance of the agreement or to comply with a legal obligation. We use the following processors:

5.1 Teamleader

We use Teamleader as our CRM system for relationship management, quotation management and project administration. Teamleader is a Belgian service that processes personal data within the European Economic Area (EEA). A data processing agreement has been concluded with Teamleader.

5.2 Twinfield (Wolters Kluwer)

We use Twinfield for our financial administration and invoicing. Twinfield is a service of Wolters Kluwer and processes data within the EEA. A data processing agreement has been concluded with Twinfield.

5.3 Tax authorities and other government bodies

Where legally required, we provide personal data to the Dutch Tax and Customs Administration or other competent authorities.

5.4 No sale of data

Dolphin Publications B.V. does not sell personal data to third parties and does not share it with third parties for those third parties’ commercial purposes.

6. Security

Dolphin Publications B.V. takes appropriate technical and organisational measures to protect personal data against loss, unauthorised access or unlawful processing. This includes the use of secure connections, access controls and restricting access to personal data to employees who require it for the performance of their duties.

7. Your rights

As a data subject, you have the following rights with regard to your personal data:

  • Right of access: you may request to see which personal data we process about you.
  • Right to rectification: you may have inaccurate or incomplete data corrected.
  • Right to erasure: you may request the deletion of your data, to the extent that this does not conflict with a statutory retention obligation.
  • Right to restriction of processing: you may request that the processing of your data be temporarily restricted.
  • Right to object: you may object to the processing of your data on the basis of legitimate interest, including the use of your contact details for commercial communications.
  • Right to data portability: you may request to receive your data in a commonly used format.

You may submit your request via info@dolphin.pub. We will respond to your request within 30 days. If you believe that your rights are not being correctly observed, you have the right to lodge a complaint with the Dutch Data Protection Authority (autoriteitpersoonsgegevens.nl).

8. Changes to this statement

Dolphin Publications B.V. reserves the right to amend this privacy statement. The most current version is available at dolphin.pub. In the event of material changes, we will inform active customers and partners accordingly.
